Basic concepts of restorative mediation

Abstract

The article presents basic concepts of restorative mediation, fundamental attitudes & activities of mediator. The definition of restorative justice is introduced. The basic competence of mediator is described: ability to transform a conflict into communication. The definition of conflict in mediation differs from the one in everyday use. Process of mediation consists of set of specified aspects. The main goal of mediation is explained using standarts of restorative mediation - assistance in adjustment & mutual understanding. The fundamental activity of mediator is to clarify sources of litigants behaviour, status, needs & interests. These principals are not static. The main authors hypothesis is that during the reflection of conflict sources the movement towards acceptance of social norms is made. The notion of "restorative mediation ladder" is introduced in order to describe the characteristics of mediator work.
